When preparing the Complaint
I filed in federal court, I made it
"a short, plain statement" as the
Federal Rules of Civil Procedure require.
I remembered what a wise old attorney
taught me 15 years ago when I began
my lawsuit work. He told me that judges
may not read a complaint if its overly
complex and weighted down with too many facts.
FRCP says "a short, plain
statement". Additionally, if a complaint
is filled with numerous facts within lengthy,
complicated paragraphs, what if one of those facts turns
out to be wrong? Surely it is a strategy
be most every defense lawyer to find
some incorrect fact that the plaintiff
listed in his complaint, then to
move to have the lawsuit dismissed on those grounds.
So, to prevent this from happening
to begin with, I made my complaint so it
covers the negligence engaged in by the
federal govt, the constitutional
violations, and a few broad statements
that lets me add in additional
offenses as the suit proceeds. :)
